09/08/1999: The latest movie idea that pisses me off -- Double Jeopardy.

Posted By: skilly

Now, it is well-known that I'm not the sharpest needle in Ed Gein's sewing kit, but the concept behind this movie is FUCKED!

Correct if I'm wrong (and I know you will), but the concept of double jeopardy is that someone cannot be found guilty of a crime for which that they have already been acquitted. The idea is to keep prosecutors from harassing a suspect over and over about the same offense. Prove it or lose it, right?

This movie thinks that the law means this: Once you have been found GUILTY of a certain crime, you can never be tried again for that same crime. The premise is this: A woman is married to a man. He is thought to be murdered but there is no body to be found. She is tried and convicted of his murder. While she is in prison, she discovers that he wasn't really dead. She then plots that when she is released, she is free-and-clear to REALLY murder him because double jeopardy prevents her from being tried again for his murder.

What kind of bullshit twisting of that law is this? First of all, if her husband fakes his death, that is a felony on his part. Correct? Secondly, double jeopardy applies to the SAME crime. If she goes out and attempts to kill him again, it is a SEPARATE crime.

Will someone please explain this to me? Hollywood bigwigs cannot POSSIBLY be this stupid to let this "idea" go to fruition! Can they?
