The FTC is pushing for the establishment of a nation-wide "Do Not Call List" for consumers who do not want to be bothered by telemarketers anymore. Under the program, telemarketers could be fined up to $11,000 per violation.

The telemarketing industry is suing to stop the proposed program stating that it discriminates against their form of advertising and violates their right to free speech.

So, does telemarketing constitute free speech? Discuss.
