grundel, I do not know if the case you are refering to is from Canton, Ohio where a hair braider was caught braiding hair without a cosmotology licence. If it is not I apologize but it is similar to an Ohio Case that the General Assembly is working on.
On the surface this seems clear cut; a hair braider was working giving people a service they demanded while they gave her money that she wanted everyone was happy. then the evil "hair ploice" showed up and ruined it. Here's how the story goes. Ohio's Board of Cosmotology regulates all aspects of state's cosmotology industry. Its goal is to provide both safe environments and trained personel for those who purchase cosmotology services.
Now you will say but the customers were getting a service they wanted; the braider does not need state certification. A good point but whether or not the they claim to be only in the braiding business hair braider preform some cosmotology. Hair to be braided must be clean, free of disease then woven or braided together.
Granted the braider can allow the customer to do the shampooing that may be required but the Board of Cosmotology still cover any kind of hair weaving under its authority.
So the hair braiders say we only want to do the hair weaving parts. The Board of Cosmotology said fine we'll make a shorter course that will still encompass relevent parts of the cosmotology training but be shorter and less costly. It credits could also be used to continue on if the individual wanted to become a full cosmotologist.
This would not be good enough for the braiders who wanted full exclusion from the law for themselves.
We often hold up people who preform certain tasks to higher standards. Police and Fire people are trained as are chauffeur's licences are necessary for taxi drivers (why can't I just drive people around in my car I know how to drive?) as commercial drivers licences are needed for heavy truck drivers. All too often we are too quick to judge government efforts and lable them as "Big Brother" not realizing to concept behind them. I'm no fan of all encompassing government but I realize that we should be thankful for many govcernment inititives that there are.
