I can't speak for every state, but in Texas posession of less than an ounce of marijuana is charged as a misdemeanor and the holder is usually fined. Apparently, the sentencing depends on the actual weight of the drug one posseses and a felony occurs only if you are holding more than an ounce or if they can prove intent to distribute. (which is often the case if you are "growing your own")
