...I'd assume that means the condition you left him in, and of course pre-meditation, which I'm gonna take a wild guess and say that doesn't apply here.

The fact that the guy went to a dance later that evening says that he wasn't beaten to critical condition, But that doesn't mean they weren't trying. I don't know tthe details, did the fight get broken up, or did they beat him and leave?

Attempted murder means that the plaintiff must prove they were trying to kill him. Otherwise I'd say agravated assault and battery would be more appropriate.

I think the issue here has more to do with the all white juty and a prosecutor that's racist. Those are issues that need addressing, as with rodney king. A person has a right to a, "fair trial." I think the miranda rights can be challenged in these cases.
