I'm kind of on the fence here, too. As a determinist, the question is whether or not murderers deserve to die, but whether they can be reformed into people who wouldn't kill again. If we have the capacity to do this, then we should reform them. If not, then the death penalty is justified. Any other issue, like revenge, or if we're playing God, just complicate the issue. Yes, there's a risk of innocent lives being lost, and yes, the death penalty has a definate bias towards certain races and economic groups, but as others already said, that's an issue that relates to the law system itself, and not whether or not the death penalty is morally right.
