Umm, this seems pretty unlikely. They can write a will anyway they want..or a living will etc.
Anyways, since they get preferential treatment under American society and law in most cases, a few that we've covered (extra protection not afforded to non-homosexuals under hate crime laws being just one example, as well as affirmative action laws), I dont think it's a problem.
