Just passing by and saw your question. Since I know everything, let me help you out.
Maximus is not Lucius' father. Lucius' mother (whatever the hell her name is) was married to Lucius' father who died prior to the events in the movie. This is evidenced by Maximus' first conversation with Lucius' mother after the opening battle, when he says he mourned when he heard her husband had passed.
