I've seen the good guys pick up the bad guys' guns any number of times. Recently I saw a cop flick in which a very competent female agent picked up a fallen gun, pulled the clip, counted bullets, and snapped it back in place before going on with the chase. This amazed me. If I picked up a fallen gun, I'd probably check to make sure the safety was off, if I could find it, but it would never have occured to me to make sure the thing had bullets in it.
