I think it was intended that the original Zorro was so devastated by the death of his wife that he lost all will to live and allowed himself to rot for twenty years in a cell. This makes crude Hollywood sense but for the fact that his daughter was now going to be raised by his worst enemy. That would certainly provoke an interest in escape in me, even if I would have to make my way to Spain to find my enemy.
No, the odd thing is that he wasn't executed immediately. Ruthless dictators almost never suffer their enemies to live once they have them in their power. And given that so many of the people rotting in that prison were probably political prisoners likely to receive pardon by the new Mexican government, it would be a huge risk to put Zorro in jail. He might be right back out again in a month.
