The new Senate sits before the the President and Vice President are sworn in. Therefore, Al Gore is the leader of the new Senate until Janurary 2oth. He would decide on who the majority party is. Though, after the swearing in of Bush and Cheney (pretty certain thing as of this afternoon), Cheney would indeed be the deciding factor in any ties of votes within the Senate.
