I take it all back. Honest. I'm wrong. Now for the real answer to both questions.
Gerard watched The Crossing Guard and Dead Man Walking so many times that he realized that killers are human, and shouldn't be killed by the federal government. After all, they're not all bad men, they're simply misunderstood.
