Don't count on it.

I think a more just punishment would be to gather the gentlemen that lied, er testified, before Congress, stating that they didn't think that nicotine was addictive. They could strap them down in front of one of those neat little cigarette testing machines that you would see in those films in the 50s and 60s and the cigs could just be kept popping into their mouths. I think maybe a two to three year stretch of doing that day and night would be at least some sort of rough justice.
