it is the product of Federal court decisions made during the course of the twenieth century. This is due to the interpretation that the first amendment right to freedom of religion necessesiates a seperation of church and state to ensure it.
Even if it isn't explicitly laid out in the constitution, that principal of seperation is vital, especially at a time in which theocrats are coming out of the woodwork with attempts to subvert the first amendment.
